Overview

The Compliance Officer – Collections & Mortgage Servicing is responsible for ensuring the credit union is operating in compliance with applicable laws, regulations, rulings, and credit union policies and procedures related to collections and mortgage servicing. Assists the VP/Chief Compliance Officer with developing, implementing, and administering all aspects of the credit union’s compliance program. Advises on emerging compliance issues, provides constructive consultation to business units, and guides the credit union in establishing controls to mitigate risk.

Essential Functions:

  • Acts as subject matter expert for all mortgage servicing and collections regulations, including but not limited to FCRA, TCPA, UDAAP, RESPA, FDCPA/Reg F, CFPB servicing rules, GSE servicing rules, and state-specific collection statutes.
  • Interprets and applies relevantregulations, ensuring all policies and procedures reflect the intent and requirements of such regulations. Collaborates with business unit to revise and create applicable polices, procedures, and controls to meet OnPoint and regulatory needs.
  • Provides guidance, recommendations, and performs research for departmental leadership and staff related to compliance-related questions, issues, or trends. Compliance Officer will proactively work to identify, assess, and mitigate risks that could impact the credit unions operations.
  • Collaborates with the Compliance Monitoring and Testing Manager to complete testing and ongoing monitoring reviews for mortgage servicing and collection activities to ensure operational adherence to applicable laws and internal policies; contributes to quality control program and testing, as needed. Collaborates with department(s) to resolve mortgage servicing and collection-related incidents and ensure appropriate follow-up actions are taken, including reporting to regulatory bodies, as appropriate.
  • Prepares detailed reports on compliance status, trends, and regulatory updates. Assists department(s) in determining appropriate actions for the resolution of issues identified by compliance, the department(s), audit, or examiners.
  • Stays current on industry standards, trends, and proposed and actual changes relating to relevant compliance topics.
  • Other duties as assigned

Knowledge, Skills and Abilities:

  • Thorough knowledge of lending laws and regulations affecting the Credit Union, particularly around federal and state regulatory requirements.
  • Familiarity with regulatory requirements under FDCPA, UDAAP, FCRA, TCPA, RESPA, TILA/Reg Z, TISA/NCUA Part 707, HMDA, e-Sign, SCRA/MLA, Reg P/Privacy, Flood, Reg B/ECOA, GAP insurance and state-specific servicing and foreclosure guidelines.
  • Strong analytical and problem-solving skills.
  • Demonstrated knowledge and experience with mining and using data from automated lending platforms.
  • Experience with MeridianLink Loans PQ loan origination system, DNA or similar core operating system, Encompass or similar mortgage lending origination and servicing systems a plus. DNA, Quick Assist, MSP, eOscar, Temenos.
  • Demonstrated strong organizational skills, with the ability to prioritize and coordinate various assignments simultaneously.
  • Ability to work independently and function under limited supervision while exercising sound judgment, speed, and accuracy.
  • Effective time management skills and the ability to work both independently and collaboratively.
  • Ability to work effectively with various teams, exhibiting strong interpersonal skills.
  • Identify tasks and create and manage a project plan in coordination with other departments.
  • Excellent verbal and written skills to effectively communicate complex legal and regulatory issues. Ability to provide concise, professional written documentation and recommendations in response to compliance research requests.
  • Strong knowledge and proficiency with Microsoft Office Suite.

Minimum Qualifications:

  • 5 years of exposure in pertinent compliance area(s), and working with related issues and reporting requirement OR
  • 7-10 years of applied operational experience in mortgage servicing and/or collections.
  • Bachelor’s Degree in Finance, Business, or related field preferred.
  • Certified Regulatory Compliance Manager (CRCM) certification, Credit Union Compliance Expert (CUCE) designation or NAFCU Certified Compliance Officer (NCCO) designation is preferred.
